Welcome to Purli. We make designer cat products that look as good in your home as they feel to your cat. These Terms of Service ("Terms") govern your access to and use of the website located at purlipets.com, together with any related pages, content, features, and services we offer (collectively, the "Site"), and your purchase of products through the Site. The Site is owned and operated by Bambi Brands LLC ("Purli," "Bambi Brands," "we," "us," or "our"), the company behind the Purli brand of designer cat products. When these Terms say "you," we mean you, the person browsing or buying.
We've tried to keep these Terms friendly and readable, but they're still a real, binding agreement, so please read them carefully before using the Site or placing an order. They include important provisions that affect your legal rights, including a limitation of liability and a section describing how disputes are resolved. 1. Agreement to These Terms
By accessing or using the Site, browsing our products, creating an account, or placing an order, you acknowledge that you have read, understood, and agree to be bound by these Terms and by all policies referenced in them, including our Refund Policy and our Privacy Policy. Together, these make up the entire agreement between you and us regarding your use of the Site and your purchases.
If you don't agree with any part of these Terms, that's okay, but please don't use the Site or place an order. We may update these Terms from time to time as described in the "Changes to These Terms" section below, and your continued use of the Site after an update takes effect constitutes your acceptance of the revised Terms.
2. Eligibility and Age
The Site is intended for users who are at least 18 years of age, or the age of majority in their jurisdiction of residence, whichever is greater. By using the Site or placing an order, you represent and warrant that:
- You are at least 18 years old, or are using the Site under the supervision of a parent or legal guardian who agrees to be bound by these Terms on your behalf;
- You have the legal capacity and authority to enter into a binding contract;
- All information you provide to us is accurate, current, and complete; and
- Your use of the Site does not violate any applicable law or regulation.
If you're under 18, you're welcome to admire the cat beds, but please only shop or use account features with the involvement of a parent or guardian. We do not knowingly collect or solicit personal information from, or sell products to, individuals under the age of 18. If you believe a minor has provided us with personal information, please contact us at hello@purlipets.com. If you are using the Site on behalf of a business or organization, you represent that you have the authority to bind that entity to these Terms.
3. Geographic Scope
Purli is a US based brand, and we currently offer and ship our products within the contiguous United States and Canada, with international orders accepted in certain cases as described in our Refund Policy. We make no representation that the Site or our products are appropriate or available for use in all locations, and we do not offer products where prohibited by law. If you access the Site from outside the areas we serve, you do so on your own initiative and are responsible for compliance with local laws.
4. Your Account
You can browse much of the Site and place orders without creating an account, but creating one makes checkout and order tracking easier. If you do create an account, a few simple responsibilities come with it.
4.1 Keeping Your Information Accurate
Please provide accurate, current, and complete information when you sign up, and keep it up to date. This helps us get your order to the right place and reach you if anything comes up.
4.2 Keeping Your Account Secure
- You're responsible for keeping your password private and your account secure, and for all activity that occurs under your account.
- Please don't share your login, and remember to log out at the end of each session when using a shared device.
- If you notice any unauthorized access to or use of your account, let us know right away at hello@purlipets.com.
4.3 Account Suspension and Termination
We may suspend, restrict, or close an account, refuse service, or cancel orders if we reasonably believe an account is being used in a way that breaks these Terms, involves false information or fraudulent or unlawful activity, or puts the Site, our team, or other customers at risk. Wherever practical, we'll act in good faith and let you know.
5. Products, Descriptions, and Pricing
We sell designer cat products, including cat beds, couches, scratchers, loungers, and scratch mats. We put real care into designing them and into describing and photographing them honestly. That said, we're human, and we can't guarantee that every product description, color, dimension, material, image, price, or other detail on the Site is completely accurate, current, or error free.
5.1 Colors and Appearance
We work hard to display product colors, materials, dimensions, and details as accurately as possible. Even so, the actual colors, textures, and finishes you receive may vary from what you see on your screen due to differences in display settings, lighting, photography, and normal manufacturing variation. Such variations are normal and do not constitute a defect.
5.2 Pricing and Errors
All prices are shown in the currency indicated at checkout and may change at any time before you place an order. Despite our best efforts, a product may occasionally be listed with an incorrect price or an inaccurate description due to typographical, photographic, technical, or other errors. We reserve the right, at any time and without prior notice, to:
- Correct any errors, inaccuracies, or omissions in product descriptions, pricing, promotions, availability, or other information, even after an order has been submitted;
- Change or update such information at our discretion; and
- Cancel, refuse, or limit any order placed for a product that was listed at an incorrect price or with an incorrect description, even after the order has been confirmed and your payment method charged.
If a product's correct price is higher than the price shown, we'll either contact you for confirmation before shipping or cancel the order and let you know. If we cancel an order because of a pricing or description error and your payment method has already been charged, we will issue a refund for the affected amount. We are under no obligation to provide a product at a clearly incorrect price.
5.3 Availability
All products are subject to availability, and we may discontinue or modify any product at any time. We do not warrant that any particular product will be available or in stock.
6. Orders, Order Acceptance, and Refusal of Service
When you place an order through the Site, you are making an offer to purchase the products in your cart subject to these Terms. All orders are subject to acceptance by us.
6.1 Confirmation and Acceptance
An order confirmation email means we've received your order; it does not by itself mean we've accepted it. A contract of sale is formed only when we accept your order, which generally occurs when we dispatch the products to you or send a notice that they have shipped. We reserve the right to accept or decline your order, in whole or in part, at our discretion.
6.2 Refusing or Canceling Orders
We reserve the right to refuse, cancel, or limit any order at our discretion, for any reason permitted by law, including in situations like these:
- The product is out of stock or no longer available;
- There's an error in pricing, product, or promotional information;
- We suspect fraud, abuse, or unauthorized activity;
- The order appears to be for resale rather than personal use, unless we've agreed otherwise;
- We're unable to verify or authorize your payment or shipping information; or
- The order exceeds quantity limits we set per person, per household, or per order.
If we cancel an order after your payment method has been charged, we will refund the amount charged for the cancelled portion.
6.3 Changing or Canceling Your Order
If you need to change or cancel an order after placing it, please reach out as soon as possible through our contact page or at hello@purlipets.com, and we'll do our best to help. Because we work to ship quickly, we cannot guarantee that changes can be made once an order has entered processing or shipped.
7. Payment, Authorization, and Promotional Codes
7.1 Payment Authorization
You agree to pay all charges incurred in connection with your order, including the product price, applicable taxes, and any shipping or duties charges, at the prices in effect when the charges are incurred. By submitting an order, you represent and warrant that you are authorized to use the payment method provided and that your billing information is true and accurate, and you authorize us, and our third party payment processors, to charge that payment method for the total amount of your order.
We may use third party services to process payments and screen orders for fraud. If your payment method cannot be verified, is invalid, or is later reversed, declined, or charged back, we may suspend or cancel your order. You are responsible for resolving any payment problems so we can proceed with your order, and we are not responsible for fees charged by your bank or card issuer.
7.2 Taxes and Duties
You are responsible for any applicable sales, use, or similar taxes. International customers may also be responsible for import duties, customs charges, and taxes imposed by their destination country, as further described in our Refund Policy.
7.3 Promotional Codes
From time to time we may offer discount codes, promotional offers, or gift cards. Unless otherwise stated, these:
- Are valid only for the specified period and while supplies or offers last, and may have minimum purchase requirements or product exclusions;
- Apply only to qualifying products and orders, and cannot be combined with other offers unless we expressly say so;
- Have no cash value, cannot be exchanged for cash, and cannot be applied to past orders;
- Are non transferable and may not be resold; and
- May be modified, limited, suspended, or revoked by us at any time, including in cases of suspected fraud, abuse, error, or use in a way we didn't intend.
8. Shipping, Risk of Loss, and Title
We're proud to offer free shipping within the contiguous USA and Canada. Detailed shipping information, processing times, coverage areas, international order terms, and related conditions are described in our Refund Policy, which is incorporated into these Terms by reference. Please review it for the full details of how we ship your order.
One important legal point: except where applicable law provides otherwise, title to and risk of loss for products pass to you once we hand them over to the carrier. From that point, the products are considered yours. Estimated delivery dates are estimates only and are not guaranteed, and we are not liable for delays caused by carriers, customs, or other events outside our reasonable control. If a package is lost or damaged in transit, we'll always try to help you make it right, and such situations are handled as described in our Refund Policy.
9. Returns and Refunds
We want you (and your cat) to love what you ordered. We offer a 30 day risk free return window for eligible orders within the contiguous USA and Canada. International returns work a little differently: international customers are responsible for return shipping and any duties or taxes. The complete details, conditions, eligibility, and process for returns and refunds are set out in our Refund Policy, which is incorporated into these Terms by reference. Please refer to the Refund Policy for all return and refund matters. In the event of any conflict between these Terms and the Refund Policy with respect to returns and refunds, the Refund Policy controls.
10. Intellectual Property and Trademarks
The Site and all of its contents, including text, graphics, logos, icons, images, photographs, illustrations, product designs, videos, copy, page layouts, software, and the selection, arrangement, and overall "look and feel" of the foregoing (collectively, the "Content"), are owned by or licensed to Bambi Brands LLC and are protected by United States and international copyright, trademark, trade dress, patent, and other intellectual property laws.
"Purli," "Purli Pets," "Bambi Brands," our logos, and related names, marks, and slogans are trademarks or trade dress of Bambi Brands LLC or its affiliates. You may not use these marks without our prior written permission. All other trademarks appearing on the Site are the property of their respective owners.
10.1 Limited License
Subject to your compliance with these Terms, we grant you a limited, non exclusive, non transferable, revocable license to access and use the Site and Content for your personal, non commercial purposes. You may not, without our prior written consent:
- Reproduce, distribute, publicly display, publicly perform, modify, or create derivative works of the Content;
- Use the Content, our designs, or our images for any commercial purpose, including resale, marketing other products, or competitive purposes;
- Scrape, harvest, frame, mirror, or use robots or other automated means to access or copy the Content; or
- Remove, obscure, or alter any copyright, trademark, or other proprietary notices.
All rights not expressly granted to you are reserved by us and our licensors.
11. Copyright Complaints (DMCA)
We respect the intellectual property rights of others and ask our community to do the same. If you believe that content on the Site infringes a copyright you own or control, please send a written notice to our designated agent that includes:
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf;
- Identification of the copyrighted work claimed to have been infringed;
- Identification of the material you claim is infringing and information reasonably sufficient to let us locate it;
- Your contact information, including name, address, telephone number, and email;
- A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law; and
- A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.
You can send DMCA notices to our designated agent at hello@purlipets.com or by mail to Bambi Brands LLC, Attn: DMCA Agent, 900 Biscayne Blvd, Unit 2710, Miami, FL 33132. We may remove or disable access to material claimed to be infringing and, in appropriate circumstances, terminate the accounts of repeat infringers.
12. Your Content and Product Reviews
We love hearing from our community, and reviews, photos, and comments help other cat parents shop with confidence. You may have the opportunity to submit reviews, ratings, comments, photos, feedback, suggestions, or other materials to the Site or our social channels (collectively, "User Content"). You are solely responsible for the User Content you submit and the consequences of submitting it.
12.1 License You Grant Us
By submitting User Content, you grant Bambi Brands LLC a non exclusive, worldwide, royalty free, fully paid up, transferable, and sublicensable license to use, reproduce, modify, adapt, publish, translate, distribute, and display that User Content in any media, in connection with our business and for marketing and promotional purposes, without any obligation to compensate you. You can ask us to remove your User Content from our owned channels at any time by contacting us at hello@purlipets.com, and we'll honor reasonable requests, though copies may remain in backups or where it has already been shared.
12.2 Your Representations
By submitting User Content, you represent and warrant that you own or otherwise control all rights to it, that it is accurate and reflects your honest opinion or experience, and that it does not infringe or misappropriate the rights of any third party, including intellectual property and privacy rights.
12.3 Content Standards
To keep things welcoming and trustworthy, please don't submit User Content that is:
- False, misleading, deceptive, or fraudulent, including fake or incentivized reviews that aren't disclosed as such;
- Defamatory, obscene, abusive, harassing, hateful, threatening, or otherwise objectionable;
- Infringing on someone else's intellectual property or privacy;
- Spam, advertising, or unrelated promotional or commercial solicitation; or
- Unlawful, harmful, or containing viruses or other harmful code.
12.4 Our Rights
We have no obligation to monitor User Content, but we reserve the right, at our discretion and without notice, to review, screen, edit, refuse, remove, or disable access to any User Content for any reason. Your User Content reflects your views, not ours, and we are not responsible or liable for any User Content or for any loss or damage arising from it.
13. Acceptable Use and Prohibited Activities
We ask that you use the Site fairly, lawfully, and in accordance with these Terms. You agree not to:
- Violate any applicable federal, state, local, or international law, regulation, or third party right;
- Engage in any fraudulent, deceptive, or misleading activity, including placing orders using false or stolen information, payment fraud, or chargeback abuse;
- Attempt to gain unauthorized access to, interfere with, damage, or disrupt the Site, our servers, our security features, or any connected systems, networks, or other accounts;
- Introduce viruses, malware, worms, or other harmful code, or attempt to circumvent any security or access control measures;
- Use any robot, spider, scraper, or other automated means to access the Site or collect data without our express written permission;
- Reverse engineer, decompile, or disassemble any portion of the Site;
- Resell, reproduce, or commercially exploit any portion of the Site or our products without authorization;
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity; or
- Use the Site in any manner that could disable, overburden, damage, or impair it, or interfere with any other party's use of the Site.
We reserve the right to investigate and take appropriate legal action against anyone who violates this section, including removing content, restricting or terminating accounts, and reporting violations to law enforcement.
14. Third Party Links and Services
The Site may contain links to third party websites, services, or resources, and may rely on third party providers such as payment processors, shipping carriers, social media platforms, and analytics or marketing tools. We provide these links and services for your convenience only and do not control, endorse, or assume responsibility for any third party websites, content, products, policies, or practices. Your dealings with any third party, and your use of third party websites and services, are solely between you and that third party and are governed by that party's own terms and policies. We encourage you to review those terms before engaging with any third party.
15. Disclaimers of Warranties
We care deeply about quality, and we want you to love what you buy. At the same time, the law requires us to be clear about a few things.
To the fullest extent permitted by applicable law, the Site, the Content, and all products are provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, statutory, or otherwise. To the fullest extent permitted by law, we disclaim all warranties, including the implied warranties of merchantability, fitness for a particular purpose, title, and non infringement, and any warranties arising out of course of dealing or usage of trade. We do not warrant that:
- The Site will be uninterrupted, secure, timely, or error free;
- Any defects or errors will be corrected;
- The Site or the servers that make it available are free of viruses or other harmful components; or
- The information on the Site is always complete, accurate, or reliable.
Our products are designed as designer pet furniture and accessories. You are responsible for supervising your pet's use of any product and for assessing its suitability for your particular pet, behavior, and environment. We make no warranty that any product is suitable for a particular animal. No advice or information, whether oral or written, obtained from us or through the Site, creates any warranty not expressly stated in these Terms.
This section does not affect any rights or warranties that cannot be excluded or limited under applicable law, including consumer protection laws that may apply to you. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.
16. Limitation of Liability
To the fullest extent permitted by applicable law, in no event will Bambi Brands LLC, Bambi Brands, or our parent, affiliates, officers, directors, employees, agents, suppliers, or licensors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or relating to your access to or use of, or inability to access or use, the Site, the Content, or any products purchased through the Site, whether based on warranty, contract, tort (including negligence), statute, or any other legal theory, and whether or not we have been advised of the possibility of such damages.
To the fullest extent permitted by applicable law, our total aggregate liability for any and all claims arising out of or relating to these Terms, the Site, or any product will not exceed the total amount you paid to us for the product(s) giving rise to the claim.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you. In such cases, our liability will be limited to the fullest extent permitted by law.
17. Indemnification
You agree to defend, indemnify, and hold harmless Bambi Brands LLC, Bambi Brands, and our parent, affiliates, and our respective officers, directors, employees, agents, suppliers, and licensors, from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or relating to:
- Your access to or use of the Site or any products;
- Your violation of these Terms or any policy incorporated by reference;
- Your User Content;
- Your violation of any law or the rights of any third party, including intellectual property or privacy rights; or
- Any misuse of your account.
We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate with us in asserting any available defenses.
18. Governing Law and Jurisdiction
These Terms and any dispute or claim arising out of or relating to them, their subject matter, or their formation (including non contractual disputes or claims), the Site, or any products purchased through the Site, are governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
Subject to the "Dispute Resolution" section below, you and we agree that any legal action or proceeding arising out of or relating to these Terms will be brought exclusively in the state or federal courts located in Florida, United States, and you consent to the personal jurisdiction of and venue in those courts. Nothing in this section limits any rights you may have under the mandatory consumer protection laws of your country or state of residence to bring a claim in your local courts.
19. Dispute Resolution
19.1 Informal Resolution
If something goes wrong, we'd much rather sort it out directly and kindly. Before initiating any formal legal action, you agree to first contact us at hello@purlipets.com or through our contact page and give us a reasonable opportunity (at least 30 days from your written notice describing the dispute and the relief requested) to resolve the dispute informally. Most concerns can be resolved quickly and amicably this way.
19.2 Governing Forum
If we are unable to resolve a dispute informally, the dispute will be handled in accordance with the "Governing Law and Jurisdiction" section above. To the extent permitted by applicable law, any claim must be brought in your individual capacity and not as a plaintiff or class member in any purported class, collective, or representative proceeding.
19.3 Your Consumer Rights
Nothing in this section limits any rights you have under applicable consumer protection laws, including any right to bring an individual action in small claims court or to pursue remedies that cannot be waived under the law of your place of residence.
20. Electronic Communications
By using the Site, creating an account, or placing an order, you consent to receive communications from us electronically, including order confirmations, shipping updates, service notices, messages posted on the Site, and emails to the address you provide. You agree that all agreements, notices, disclosures, and other communications we provide to you electronically satisfy any legal requirement that such communications be in writing.
If you opt in to receive marketing text messages, message and data rates may apply, message frequency varies, you can reply STOP to unsubscribe or HELP for help, and consent to texts is not a condition of any purchase. You may opt out of marketing communications at any time by following the unsubscribe instructions in those messages or by contacting us at hello@purlipets.com; however, we may still send you transactional communications related to your orders and account. 21. Accessibility
We want everyone, and every cat, to feel welcome at Purli, and we are committed to making our Site usable and accessible to as many people as possible, including people with disabilities. We strive to align with recognized accessibility standards and continually work to improve the experience. 22. Force Majeure
Sometimes things happen that are genuinely outside anyone's control. We will not be liable or responsible for any failure to perform, or any delay in performance of, any of our obligations that is caused by events beyond our reasonable control. These events may include acts of God, natural disasters, severe weather, fire, flood, epidemic or pandemic, war, terrorism, civil unrest, labor disputes or strikes, governmental actions or restrictions, failures of public or private telecommunications networks, internet, hosting, or utility outages, cyberattacks, carrier or supply chain disruptions, and shortages of materials or transportation. Our performance is deemed suspended for the period such an event continues.
23. Changes to These Terms
As our business grows, we may update or modify these Terms from time to time at our discretion. When we make changes, we will post the revised version here and update the "Last updated" date at the top of this page. We will take reasonable steps to communicate significant changes where appropriate, for example by a notice on the Site or by email. Changes become effective when posted or on the effective date we specify, and they will not apply retroactively to orders already placed. Your continued use of the Site after changes take effect means you accept the revised Terms, so we encourage you to review them periodically. If you do not agree to the revised Terms, please stop using the Site.
24. Severability
If any provision of these Terms is found to be unlawful, void, or unenforceable by a court or other tribunal of competent jurisdiction, that provision will be enforced to the maximum extent permissible, or reformed as little as necessary to make it valid while keeping its original intent, and the remaining provisions will remain in full force and effect.
25. Waiver
Our failure to enforce any right or provision of these Terms will not be deemed a waiver of that right or provision. Any waiver must be in writing and signed by an authorized representative to be effective, and a waiver in one instance will not constitute a waiver in any other instance.
26. Survival
Any provisions of these Terms that by their nature should survive termination or expiration will survive, including provisions relating to intellectual property, user content, disclaimers of warranties, limitation of liability, indemnification, governing law, dispute resolution, and these general provisions.
27. Entire Agreement
These Terms, together with our Refund Policy, Privacy Policy, and any other policies or notices posted on or expressly incorporated into the Site, constitute the entire agreement between you and us regarding your use of the Site and your purchases, and supersede all prior or contemporaneous understandings, agreements, representations, and warranties, whether written or oral, on the same subject matter.
28. Assignment
You may not assign, transfer, or delegate these Terms, or any of your rights or obligations under them, in whole or in part, without our prior written consent, and any attempted assignment in violation of this section is void. We may freely assign or transfer these Terms and our rights and obligations under them, in whole or in part, without restriction, including in connection with a merger, acquisition, reorganization, or sale of all or substantially all of our assets. These Terms will bind and benefit the parties and their permitted successors and assigns.
